Compliance Monitoring and Technical Assistance

Federal requirements mandate that app Educational Agencies (SEAs) provide technical assistance to Local Educational Agencies (LEAs) and juvenile justice facilities, as well as oversee and monitor the implementation of Elementary and Secondary Education Act (ESEA) as reauthorized by the Every Student Succeeds Act (ESSA). These responsibilities are some of the primary work of the Office of ESSA-Funded Programs at the New app app Education Department (app or "the Department").

Each year, the Office of ESSA-Funded Programs uses a risk-based approach to select LEAs from across New app app for monitoring reviews to determine compliance with requirements outlined in ESEA and New app app Commissioner’s Regulations. Based on that understanding, staff monitor for compliance and provide technical assistance related to the programmatic and fiscal requirements under the following programs:

  • Title I Part A Improving Basic Programs
  • Title I Part C Education of Migratory Children
  • Title I Part D Neglected and Delinquent Programs
  • Title I School Improvement
  • Title II Part A Supporting Effective Education
  • Title III Part A English Language Learners
  • Title IV Part A Student Supports and Academic Enrichment
  • Title V Part BRural Education Achievement Program (REAP)
  • McKinney-Vento Homeless Education
  • American Rescue Plan Homeless Children and Youth (ARP HCY) I and ARP HCY II

The Office of ESSA-Funded Programs conducts four types of monitoring of the programs outlined above:

While the underlying mandate of monitoring is compliance-focused, the Department recognizes that compliance is the minimum requirement. To expand the focus from compliance to continuous improvement and maximum impact of each monitored program, staff work to engage with LEA and facility representatives throughout the monitoring process to provide targeted technical assistance that address an LEA’s specific programmatic and fiscal implementation needs.

COORDINATED MONITORING REVIEW

​The Coordinated Monitoring Review is conducted by the app Office of ESSA-Funded Programs. The review is designed to ensure that the District is following the programmatic and fiscal plans submitted in the Consolidated Application and maintaining compliance with the ESSA assurances embedded within the application.

At least 3 days prior to review visit, app unsubmits monitoring survey to LEA with Preliminary Ratings.

app conducts scheduled review visit over 1-2 days.

No later than July, 2024

After the review visit, LEA has 5 days to upload additional materials to address Preliminary Ratings.

After the 5-day period, LEA will receive Final Ratings from app within 30 days.

August, 2024

After LEA receives Final Ratings, LEA has 30 days to address any Required or Corrective Actions and resubmit to app.

The LEA maintains communication with the reviewer regarding Required or Corrective Actions that need more time to complete.

The LEA completes any remaining Required or Corrective Actions, including those that involves BOE approval for policy changes.

If the LEA does not complete remaining Required or Corrective Actions, SED will arrange a virtual meeting with the Superintendent to discuss the prompt resolution of any open Required or Corrective Actions.

If the LEA does not complete remaining Required or Corrective Actions, SED will notify the BOCES Superintendent of any open Required or Corrective Actions, and request assistance with supporting the LEA in completion of these items.

The 2024-25 Consolidated Application for ESSA-Funded Programs will not be approved until the Coordinated Monitoring Review is completed and approved.

TARGETED MONITORING REVIEW

SELF ASSESSMENT

The Self-Assessment is conducted by the LEA. The app Office of ESSA-Funded Programs uses the results of the Self-Assessment to engage with staff from LEAs throughout the state to provide technical assistance with the goal of ensuring the effective implementation of programs that maximize outcomes for students.
